- Welcome to Mfoodie2Go (“Platform”, “Mfoodie2Go”, “we”, “us”, “our”).
These Terms of Use govern your access to and use of the Mfoodie2Go website, mobile application, marketplace services, payment systems, collection services, delivery services, merchant tools, subscription services, and all related business management services made available through our platform.
By accessing, registering, purchasing, selling, advertising, or using any service on the Platform, you agree to be legally bound by these Terms.
1. Definitions
For purposes of these Terms:
- Customer means any person purchasing goods or services through the Platform.
- Vendor / Merchant / Shop means any restaurant, fast food outlet, grocery store, spaza shop, service provider, or seller listed on the Platform.
- Subscription Merchant means a business paying a monthly listing or management fee.
- Order means any purchase, booking, collection, or delivery transaction.
- Storefront means an individual business profile, branch, outlet, shop page, or service location listed on the Platform.
- Platform Fee means any commission, subscription fee, service fee, or administrative charge applicable to the services.
- Collection Order means an order paid online and collected later by the customer.
- Third-Party Providers include payment processors, logistics partners, BNPL providers, banks, and digital wallet services.
2. Platform Services
Mfoodie2Go operates as a digital marketplace and business service platform connecting:
- restaurants
- fast food outlets
- takeaway businesses
- grocery sellers
- spaza shops
- food stalls
- service providers
- delivery partners
- customers
The Platform enables:
- online sales
- storefront listings
- subscriptions
- payments
- deliveries
- collections
- advertising
- service bookings
- multi-store management
Mfoodie2Go acts as a technology intermediary and marketplace facilitator, unless expressly stated otherwise.
3. Account Registration
Users may register as:
- customers
- vendors
- restaurants
- shops
- service providers
- advertisers
- resellers
You are responsible for:
- maintaining accurate account information
- keeping login credentials secure
- all activity under your account
We reserve the right to suspend or terminate accounts for fraud, misuse, illegal activity, or breach of these Terms.
4. Orders
All orders are subject to:
- stock availability
- merchant acceptance
- payment confirmation
- successful checkout
- delivery or collection arrangements
Order confirmation does not guarantee fulfilment until formally accepted by the relevant merchant.
5. Mfoodie2Go Pay & Collect Later
Customers may pay online and collect their orders later from the selected shop.
5.1 Free 24-Hour Collection
Collection is free for 24 hours from payment confirmation.
5.2 Failure to Collect
Orders not collected within 24 hours may be deemed uncollected.
A 3.5% penalty fee shall apply:
Penalty Fee = Order Value × 3.5%
5.3 Allocation of Penalty Fee
- 1.5% retained by Mfoodie2Go as administrative costs
- 2% paid to the merchant
5.4 Perishable Items
Prepared meals, beverages, and perishable goods may be forfeited, disposed of, or become non-refundable after the collection period expires.
Repeated failure to collect may result in account restrictions.
6. Payments
Payments may be processed via:
- debit cards
- credit cards
- EFT / instant EFT
- digital wallets
- Google Pay
- Apple Pay
- BNPL services
- Mfoodie2Go Pay
By making payment, the user authorises Mfoodie2Go and its approved third-party providers to process the transaction.
7. Fees and Commissions
7.1 Standard Platform Fee
A 5% platform fee applies to all qualifying sales.
Formula:
Platform Fee = Sale Amount × 5%7.2 Third-Party Charges
Payment gateway and delivery fees may apply separately and may be deducted from merchant settlements.
8. Subscription Plans
Single Account Plan
From R75 per month
Includes:
- 1 storefront
- standard listing
- pay & collect
- customer orders
- business profile
Unlimited Listing Plan
From R125 per month
Includes:
- unlimited listings
- inventory control
- stock tracking
- dashboard access
Multiple Shops Management Plan
From R1,025 per month
Supports up to 10 storefronts
Includes:
- centralised dashboard
- branch inventory
- reporting
- promotions management
Additional storefronts may attract separate pricing.
9. Commission Exclusion
Subscribed businesses on approved plans are excluded from the standard 5% platform fee unless otherwise agreed in writing.
Third-party payment and delivery fees remain applicable.
10. Withdrawals and Payouts
Merchant payouts are processed weekly on Tuesdays.
Minimum Withdrawal
Minimum withdrawal amount: R125
Balances below this threshold roll over.
Deductions
Before payout, Mfoodie2Go may deduct:
- commissions
- subscription fees
- payment gateway fees
- delivery fees
- refunds
- chargebacks
- penalties
11. Refunds and Cancellations
Refunds are subject to:
- the Consumer Protection Act 68 of 2008
- merchant policies
- product nature
- preparation status
Prepared food and perishable goods may not be refundable once prepared, unless defective or non-compliant with consumer law.
12. Merchant Responsibilities
Merchants are solely responsible for:
- food quality
- food safety
- legal permits
- pricing accuracy
- stock accuracy
- health compliance
- service fulfilment
13. Prohibited Use
Users may not:
- commit fraud
- impersonate businesses
- upload malicious software
- submit false reviews
- list illegal goods
- sell expired food
Violations may result in suspension or permanent termination.
14. Privacy and Data Protection
All personal information is processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and applicable South African law.
15. Limitation of Liability
Mfoodie2Go shall not be liable for:
- merchant failures
- food quality issues
- payment gateway failures
- delivery delays
- indirect losses
- loss of profits
To the fullest extent permitted by South African law.
16. Termination
We may suspend or terminate access immediately where fraud, abuse, illegal conduct, or breach of these Terms is suspected.
17. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
All disputes shall fall under the jurisdiction of South African courts.
